Terms and Conditions
By using the services of Bright Movers Ottawa (hereafter referred to as “the Company”), the Client enters into legal relations with the Company under these Terms and Conditions of Service (hereafter referred to as “T&C”). Customers must read and accept these terms before signing the Bill of Lading. By signing, the Customer agrees to these terms, along with any related documentation, including labor rates, surcharges, service estimates, and preparation guidelines.
Liability of the Company
All services include standard liability coverage at no additional charge. Liability is limited to $0.60 per pound per item, unless otherwise agreed in writing. This coverage is not full replacement insurance.
Exceptions to Liability
The Company shall not be liable for:
- Force Majeure: Loss or damage caused by events beyond the Company’s control (e.g., fire, flood, weather, strikes)
- Malfunctions: Mechanical or electronic defects in appliances or equipment
- Material Damage: Damage to items made of particleboard, pressboard, or similar materials
- Fragile Items: Damage to glass, marble, or veneer unless caused by negligence
- Environmental Factors: Damage due to aging, temperature changes, humidity, or moisture
- Packed by Owner (PBO): Items packed by the Customer are moved at the Customer’s own risk
- Undisclosed High-Value Items: Items such as jewelry, cash, or important documents not declared in advance
Delays
The Company shall not be held liable for delays caused by circumstances beyond its control. Additional charges may apply for storage, handling, or redelivery if delivery cannot be completed as scheduled.
Stoppage in Transit
If goods are moved within the Customer’s premises at their request, such services may be subject to additional charges and performed at the Customer’s responsibility.
Notice of Claim
All claims for loss or damage must be submitted in writing within 7 days of the move date. The Customer must inspect all items prior to the crew leaving the destination.
Articles of Extraordinary Value
Customers must disclose high-value or sensitive items in advance. The Company does not assume liability for such items unless agreed to in writing.
Moving Charges
Rates are set at the time of booking and are charged in 15-minute increments, with a minimum of three (3) hours of labour. Additional charges may apply for heavy, bulky, or specialty items.
Goods Held in Lieu of Payment
The Company reserves the right, in accordance with applicable Ontario laws, to retain possession of goods until full payment is received.
Customer Responsibilities
Customers must ensure:
- Proper packing of boxes and protection of fragile items
- Clear and safe access to all areas, including parking arrangements
- Safe working conditions at both pickup and delivery locations
- Accurate information regarding items and access conditions
Building Delays
The Company is not responsible for delays caused by building restrictions, elevator unavailability, or loading dock limitations. Such delays may be subject to additional charges.
Winter Conditions
Customers are responsible for ensuring that driveways, walkways, and entrances are cleared of snow and ice. The Company shall not be liable for delays or damages caused by unsafe conditions, unless due to negligence.
Dangerous Goods
The Company does not transport hazardous, illegal, or combustible materials. The Customer is responsible for declaring any such items.
Undelivered Goods
If goods cannot be delivered, the Customer will be notified and additional charges may apply for storage or return.
Return of Goods
If no instructions are provided within ten (10) days, undelivered goods may be returned to the Customer at their expense.
Free In-Home Service Estimates
Bright Movers Ottawa offers free in-home estimates. These estimates are based on the information provided and are subject to change if conditions differ.
Payment is due in full upon completion of the move and prior to the departure of the crew.
Cancellation and Rescheduling
- Rescheduling is subject to availability
- Cancellations made within 72 hours of the scheduled move may result in charges or loss of deposit
Additional Services
Packing and unpacking services are available at an hourly rate. Customers are responsible for arranging access, elevator bookings, and site readiness prior to the move.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the Customer and the Company and supersede all prior discussions or representations, whether oral or written. No verbal statements shall be relied upon unless confirmed in writing.
Right to Refuse Service
The Company reserves the right to refuse or discontinue service if working conditions are unsafe, required information is not disclosed, or payment terms are not met.
